PRIVACY POLICY
This Privacy Policy sets out how Bayes Recruitment Pte Ltd (“Bayes”, “we”, “us”, “our”) collects, uses, discloses and manages the personal data of individuals in accordance with the Personal Data Protection Act 2012 (“PDPA”), as amended by the Personal Data Protection (Amendment) Act 2020. By engaging with Bayes or submitting your personal data to us, you acknowledge and agree to the terms of this Privacy Policy.
Personal Data We Collect
Under the Companies Act, Bayes is listed as a Recruitment Specialist and all personal data collated pertains to information relating to an individual’s employment and its contributing factors to hiring procedures. While not exhaustive, this includes:
Educational background, career history and experience, salary and remuneration
Opinions of others about your work performance
Referees and references (upon your acknowledgement)
Results of any psychometric, competency or medical test
Performance feedback (whether positive or negative) by your previous or new employer
Any complaint, accident or incident, investigation, litigation, registration or professional disciplinary matter, criminal matter, inquest or inquiry in which you are involved from or about you in the previous or new workplace
All information is collected for the sole purpose of the provision of recruitment and/or related intermediary services to or for you.
Purpose of Collection
The purposes for which your personal data is collected are limited to those set out in this Policy and are reasonably necessary for the provision of recruitment and related intermediary services, in accordance with Section 18 of the PDPA. Personal data will not be collected, used or disclosed beyond these stated purposes without your further consent, except as required or permitted by law.
We will or may use your personal data to:
Maintain, update and improve on existing information you have placed within our systems for your actual or possible work placements
When, upon a potential employer’s request, directly undertake various forms of reference check with relevant governmental agencies, past/present employers and/or credit checks — provided that you have given your express prior consent to each specific type of check requested
Ensure our internal business procedures are running smoothly, which may include service evaluations, quality audits, fulfilling legal liabilities and the conducting of confidential systems maintenance and testing
Computation of payment for work completed on a temporary or contractual basis
Update and offer you work, potential career opportunities or to ascertain potential availability for employment opportunities
Identification of any or potential training requirements
Management of any complaint, investigation or inquiry in which you are involved in through the course of employment
Disclosing submitted information in response to a request made by any government authority or regulator
Consent & Submission of Personal Data
Bayes collects personal information when you submit a job application or resume through the mediums we utilise, or when you attend an interview with one of our Consultants. All information is obtained on a voluntary-submission basis and is non-obligatory.
By submitting an application, you acknowledge and agree that you are providing personal information to Bayes to consider you as an appropriate candidate for present and future opportunities. Such information may be shared with our partners, subsidiaries and affiliates for the purpose of recommending or securing you a career opportunity.
You must not include your NRIC details in any application until a further official written request is received from an authorising Consultant. This is in accordance with the PDPC’s Advisory Guidelines on the PDPA for NRIC and Other National Identification Numbers.
Data Retention
Bayes will retain your personal data for as long as is necessary to fulfil the purposes for which it was collected, or as required by applicable law. As a general guide, personal data of candidates not placed in employment is retained for a period of up to two (2) years from the date of last active engagement, after which it is securely destroyed unless you have consented to longer retention or we are required by law to retain it.
Where permitted by law, Bayes will destroy and permanently remove personal information that is no longer needed for any purpose permitted by the PDPA.
Data Quality & Integrity
Bayes will take all reasonable steps to:
Ensure that the personal information we collect, use and disclose is accurate, complete and up-to-date, but only in accordance with the information that you have provided or updated
Protect the personal information that we hold from misuse and loss and from unauthorised access, modification or disclosure through a strict staff confidentiality policy agreement that must be undertaken at the point of their employment
Where permitted by law, destroy and permanently remove personal information that is no longer needed for any purpose permitted by the PDPA
Withdrawal of Consent
If you do not wish for us to retain or use your personal data for potential or future employment or the stated uses set out above, you must email our Data Protection Officer at SG@bayesrecruitment.com to state your intention to withdraw consent. We will review your request and respond to you with the appropriate actions of such withdrawal.
Please note that withdrawal of consent may affect our ability to continue processing your application or providing recruitment services to you. We will inform you of the likely consequences of withdrawal before processing your request.
Mandatory Data Breach Notification
In accordance with the PDPA as amended by the Personal Data Protection (Amendment) Act 2020, Bayes is obliged to notify the Personal Data Protection Commission (PDPC) of any notifiable data breach within three (3) business days of becoming aware of the breach. Where the breach is likely to result in significant harm to affected individuals, Bayes will also notify those individuals as soon as is reasonably practicable.
A notifiable data breach is one that results, or is likely to result, in significant harm to the individuals whose personal data is involved, or is of a significant scale. If you believe your personal data held by Bayes has been compromised, please notify us immediately at SG@bayesrecruitment.com.
